1. What EAAPass is
EAAPass is a private commercial service that provides automated web accessibility auditing, monitoring, and remediation tools based on WCAG 2.1 Level AA criteria.
EAAPass is not:
- A government or regulatory body
- An official certification authority
- A substitute for legal advice or legal compliance assessment
- Affiliated with, endorsed by, or representing any EU institution, national authority, or accessibility standards body
Our service helps website owners identify and fix accessibility issues to work towards compliance with the European Accessibility Act (EAA/Directive 2019/882). However, using EAAPass does not guarantee legal compliance, and our certificates and badges represent the results of our automated testing — not an official legal certification.
2. Operator
EAAPass is operated by TechsOn (Tecnologias Online Lda), registered in Portugal. Contact: info@eaapass.eu
3. Service description
EAAPass provides:
- Automated accessibility scanning — using axe-core, Lighthouse, and Pa11y engines to detect WCAG 2.1 AA violations
- Compliance reports — detailed violation reports with remediation guidance
- Certificates and badges — issued when a website scores 80% or above on our automated tests, valid for 3 months
- Monitoring — weekly automated scans with regression alerts
- WordPress plugin — per-page scanning and auto-fix tools
- Remediation services — professional accessibility fixes by our team (quoted separately)
4. Acceptable use
You may use EAAPass to audit websites that you own or have authorisation to audit. You agree not to:
- Submit URLs for the purpose of attacking or disrupting other websites
- Circumvent rate limits or abuse the free tier
- Use the service to generate misleading compliance claims
- Present EAAPass certificates as official government certifications
- Resell audit results without a reseller/agency plan
5. Audit limitations
EAAPass performs automated testing only. Automated tools can detect approximately 30-40% of WCAG 2.1 AA criteria. Full WCAG conformance requires manual testing with assistive technologies (screen readers, keyboard navigation, etc.).
Our audits and certificates do not constitute:
- A legal compliance certification under the European Accessibility Act
- A guarantee of full accessibility for all users
- Legal advice or a legal opinion
- A substitute for manual accessibility testing by qualified professionals
- An exemption from any regulatory requirements or inspections
Scores and violation counts are indicative. They may vary between scans due to dynamic content, network conditions, or engine updates. A score of 100/100 on our automated tests does not mean a website has zero accessibility barriers — it means no automated violations were detected.
6. Certificates and badges
EAAPass certificates (format: EAA-YYYY-XXXX) are issued when a website scores 80% or above. Certificates:
- Are valid for 3 months from the date of issue
- Expire automatically and badges will no longer display
- Can be renewed by running a new audit
- Represent automated test results only — not official compliance certification
- May be revoked if the website is found to be intentionally misleading about its accessibility
7. Payments and refunds
Paid reports (€17 one-time) and monitoring subscriptions (€9.90/month) are processed by Stripe. All prices include applicable VAT.
Refunds are available within 14 days of purchase if the report could not be generated due to a technical failure on our part. Refunds are not available for successfully delivered reports or for monitoring subscriptions after the first scan has been delivered.
8. Intellectual property
Audit reports are licensed to you for internal use. The report format, methodology, scoring system, and branding remain the property of TechsOn. You may share reports with your development team and stakeholders.
9. Data and privacy
Your use of EAAPass is subject to our Privacy Policy. By using the service, you consent to the processing described therein.
10. Disclaimer of warranties
EAAPass is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that audit results will be complete or accurate. We do not warrant that achieving a high score on our tests will prevent regulatory action, fines, or legal claims related to accessibility.
11. Limitation of liability
To the maximum extent permitted by law, TechsOn shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of EAAPass, including but not limited to fines, penalties, legal costs, or business losses related to accessibility non-compliance. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
12. Governing law
These terms are governed by the laws of Portugal. Any disputes shall be subject to the jurisdiction of the courts of Portugal, without prejudice to mandatory consumer protection rules in your country of residence.
13. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via the website. Continued use of the service after changes constitutes acceptance.
